The purpose of these General Terms and Conditions of Use is to govern the terms and conditions of access to and use of the IFCAM coaching management platform made available to Crédit Agricole Group entities (hereinafter referred to as the "GTCU").

The Platform refers to the site from which Users can access a set of coaching-related functionalities described in these GCU (hereinafter referred to as "the Platform").

A user of the Platform is any person connecting to or accessing the Platform (hereinafter, "User").

 

1.1. Use of the Platform is subject to compliance with these GCU.

1.2. The GCU may be modified by IFCAM in particular to take into account changes in the Platform's functionalities and applicable regulations.

 

2.1. The Platform allows Users to access different functionalities, according to their respective qualities.

2.2. There are different types of Users on the Platform:

• The "IFCAM Manager": administers the Platform;
• The "Entity Manager": manages an area of the Platform dedicated to a specific entity;
• HR Facilitator": manages one or more coaching sessions for a specific entity;
• Coach": provides coaching for coachees;
• The "Coachee": benefits from coaching provided by the coach;
• The "Guest": is a person invited to attend certain "tripartite" coaching meetings.

2.3. The Platform has several functionalities accessible via "menus":

• The "Intervenants" menu: gives access to the search page for intervenants referenced on the Platform. It is accessible to all types of Users;
• The "Courses" menu is divided into several sub-menus, each with its own functionalities:
• "Search courses": is accessible to all Users except Guests, and gives access to the search page for coaching courses referenced on the Platform;
• "My Courses" is accessible to Coaches and Coachees. Via this sub-menu, Coaches can access their available courses, and Coachees their registered courses;
• "Course Management": is accessible to IFCAM Managers, Entity Managers and HR Facilitators, and enables them to access available courses and courses awaiting validation. In particular, they can modify and moderate information before validating publication;
• The "Library" menu is also divided into several submenus:
  "My shared documents": is accessible to all Users, except Guests, and gives access to all shared documents in the Platform library, common to all Entity Spaces. It is also possible to publish a document at different levels (Platform, Entity Space or Coaching Circle bringing together the Coachee and the Coach);
• "My Saved Documents": is accessible to all Users, except Guests, and provides access to documents saved in your personal library;
• "Search documents": is accessible to all Users, except Guests, and gives access to the search page for documents referenced on the Platform;
• "Document Management": is accessible to IFCAM Managers, Entity Managers and HR Facilitators, and provides access to available documents and documents awaiting validation. In particular, they can modify and moderate information before validating publication.
• The "Agenda" menu: is available to Coaches and Coachees to access their agenda and scheduled appointments on the Platform.
• The "Messaging" menu is accessible to all Users, except Guests, and enables them to access the Platform's internal messaging system.

 

3.1. To access the Platform, the User must identify him/herself by means of an identifier and password, which are initially communicated to him/her by IFCAM. To this end, Users must enter their login and password on the home page of the Platform.

3.2. Creating a new password

Each User must personalize his/her password when logging on to the Platform for the first time, in compliance with the robustness requirements requested by IFCAM.

The User has five attempts to connect to the Platform with his login and password. After three unsuccessful attempts to connect, access to the Platform will be temporarily suspended. The duration of the block increases with the number of repeated unsuccessful attempts.
 

 

4.1. The Platform and each of its components, in particular the texts, images, illustrations, photographs, databases, media, software, graphics, logos, icons, sounds, company names, trademarks, product models, drawings, animated sequences with or without sound, and other documentation, and more generally, all visual or sound elements including the underlying technology represented on the Platform (hereinafter the "Intellectual Property Elements") are protected by intellectual property rights.

4.2. The User undertakes not to reproduce, represent, modify, translate, adapt or distribute, by any means whatsoever, the documents, media, videos or any other Intellectual Property Elements, unless previously authorized by the holder of the intellectual property rights, under penalty of committing an infringement offence in accordance with articles L.335-2 et seq. of the French Intellectual Property Code.

4.3. Except as authorized by the laws and regulations in force, any reproduction, representation, modification, adaptation, translation, and/or total or partial transformation, integration into other elements or transfer to another website of all or part of the Intellectual Property Elements without the prior express written authorization of the Publisher or of the third parties concerned who hold the Intellectual Property rights is strictly prohibited.

 

When using the Platform, IFCAM processes personal data.

For the purposes hereof, personal data refers to information that directly or indirectly enables the User to be identified, as this term is defined by the regulations applicable to the protection of personal data (hereinafter referred to as the "Data").

5.1. Purposes of processing by IFCAM

The Data is processed by IFCAM on the basis of a legitimate interest, for the purposes of providing Users with access to the Platform and enabling them to use its various functionalities.

5.2. Recipients of Data

5.2.2. As part of the processing carried out by IFCAM, the User is informed that only IFCAM's internal departments responsible for administering the Platform have access to the Data.

5.3. User rights

5.3.1. In accordance with Data protection regulations, the User has the following rights concerning the processing of his/her Data:

• Right of access ;
• Right of rectification;
• Right to erasure ;
• Right to limit processing;
• Right to object.

5.3.2. The User may exercise these rights at any time by sending a written request electronically to donneespersonnelles@ca-ifcam.fr.

5.3.3. The User also has the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (Cnil).

5.3.4. IFCAM has appointed a Data Protection Officer (DPO) whose contact details are as follows: IFCAM 6 Pôle Contrôle Interne et Juridique - DPO - 12 place des Etats-Unis - CS 9001 - 92127 MONTROUGE CEDEX.

5.4. Data retention period

5.4.1. Data is kept for as long as the User has the right to access the Platform.

5.5. Data security and confidentiality

IFCAM undertakes to take all necessary precautions, in view of the nature of the Data and the risks presented by the processing, to preserve the security of the Data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties.

 

 

6.1. Commitments of the User
6.1.1. The User undertakes to use the Platform in accordance with these GCU. 
6.1.2. The User's login and password are personal and confidential. The User is solely responsible for the use of his/her login and password. In this respect, the User undertakes not to communicate them to any third party whatsoever.
The User undertakes to inform IFCAM, without delay, of any breach of confidentiality, compromise, loss or anomaly concerning these. Any change of password by the User shall be carried out in accordance with these GCU.
6.1.3. The User undertakes not to make any use of the Platform that is contrary to the legal and/or regulatory provisions in force, or to the provisions of these GCU.
When using the "Messaging" and "Library" menus, the User may publish content, hereinafter referred to as "Content", on the Platform. The User undertakes to ensure that the Content does not infringe the rights of third parties or the image of IFCAM and/or any Crédit Agricole Group entity.
6.1.4. In particular, the User undertakes to ensure that any Content he/she publishes does not include or point to websites containing, without this list being exhaustive :

• Content that is pornographic, pedophilic, violent, obscene or seriously offensive to human dignity;
• Content that infringes or violates the property rights of a third party and/or IFCAM;
• Content promoting the goods or services of a third party and/or a competitor of IFCAM and/or any Crédit Agricole Group entity;
• Unsolicited advertising messages (spam);
• Content that could be qualified as, or constitute incitement to: the commission of crimes or offenses, discrimination, hatred or violence, particularly on the grounds of race, apology for Nazism or terrorism, denial of the existence of crimes against humanity, undermining the authority of justice, defamation, insult, disparagement, invasion of privacy, or acts endangering minors;
• Content intended to display prohibited objects or works, messages of a defamatory, rude, insulting, violent nature or contrary to the laws in force, messages on tobacco and alcohol, content containing personal contact details and information allowing precise geographical location (telephone number, address, etc.), messages inciting to violence or violence against children. ), messages inciting the consumption of prohibited substances or suicide, messages enabling third parties to obtain directly or indirectly pirated software, software serial numbers, software enabling acts of piracy and intrusion into computer and telecommunications systems, viruses and other logic bombs and, in general, any tool, software or message enabling infringement of the rights of others and the security of persons and property in violation of the privacy of correspondence.

6.1.5. In any event, IFCAM reserves the right to moderate Content. Thus, IFCAM may remove or not publish any Content that is contrary to the GCU and/or applicable regulations.

6.2. IFCAM's commitments

6.2.1. IFCAM uses all reasonable means at its disposal to ensure quality access to the Platform.

In this respect, the Platform is accessible unless interrupted for maintenance and/or in the event of force majeure and/or in the event of the occurrence of an event beyond the control of IFCAM.

6.2.2. IFCAM may not be held liable in the event of network and/or server malfunction or any other event beyond its control, which prevents and/or degrades access to the Platform.

6.2.3. IFCAM may not be held liable in the event of fraudulent use of the User's login and password by a third party due to negligence on the part of the User or failure to comply with the security instructions defined herein.

6.2.4. IFCAM may not be held liable in the event of use of the Platform that does not comply with these GTUs and with the regulations in force, or in the event of the User providing inaccurate or incomplete information in response to a request from IFCAM, or in the event of the User's browser being set to automatically identify him/herself, thereby enabling a third party, where applicable, to access and use the Platform.

 

The Platform may include information provided by external companies or hypertext links to other sites that have not been developed by IFCAM.
The existence, on the Platform, of a hypertext link leading to another site does not constitute validation of this other site or its content by IFCAM.

IFCAM therefore assumes no responsibility for the content, advertising, products or services available on or from these sites.

Furthermore, IFCAM cannot be held responsible for the information, opinions and recommendations formulated by these third parties.
Any link to the Platform must be expressly authorized in advance by IFCAM, which reserves the right to remove the link at any time.

 

8.1. In the event that one of the clauses of these GCU is declared null and void or inapplicable by a law, regulation or court decision rendered by a competent jurisdiction, the other clauses shall retain their validity and force.

8.2. The fact that IFCAM does not require the application of any clause of the GCU, whether permanently or temporarily, shall in no way be interpreted as a waiver on its part of the rights arising for it from the said clause.

 

9.1. These GCU are governed by French law.

9.2. In the event of a dispute, the Parties will make their best efforts to reach an amicable solution before any recourse to the Courts. However, in the event of failure to reach an amicable settlement, the more diligent party shall refer the matter to the competent court, and where applicable to the court having jurisdiction over IFCAM's registered office.
